This traumatic birth claim was one of the first to fall within the NHS Litigation Authority’s Early Notification Scheme. The Scheme was designed to ensure that investigations took place expeditiously and thoroughly to ensure that any failings identified could be acted upon. From 1 April 2017 Healthcare Trusts in England were required to report to the NHS Litigation Authority, within 30 days, all maternity incidents involving potentially severe brain injury; namely all babies born at term (≥37 completed weeks of gestation), following labour, that had a potentially severe brain injury diagnosed in the first seven days of life.
Failings by the maternity unit at the hospital led to a delay in delivering the our client’s son. The Trust accepted at an early stage that her son experienced avoidable hypoxia, and this caused him to suffer irreversible brain damage as a result of their negligence.
While the child’s claim is still ongoing, the mother has received traumatic birth compensation for the psychiatric harm she suffered as a result of the Trust’s negligence in handling her labour and her son’s birth.
